1. Who we are
This website (britcommercial.com) is operated by BRIT Commercials Ltd, a used commercial vehicle and HGV dealer based in Derby, United Kingdom. For the purposes of the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, BRIT Commercials Ltd is the data controller responsible for your personal data.
2. The personal data we collect
We only collect the information we need to deal with your enquiry and sell or support your vehicle purchase. This may include:
- Identity & contact data – name, company name, email address, telephone/WhatsApp number and postal address.
- Enquiry data – the vehicle you are interested in, your message, part-exchange vehicle details and finance or export requirements.
- Transaction data – details of vehicles purchased, deposits, invoices and delivery or collection arrangements.
- Marketing preferences – whether you have asked to receive new stock alerts and offers.
- Technical data – IP address, browser type, device information and pages visited, collected through cookies and analytics tools.
We do not knowingly collect special category data, and our services are not aimed at children.
How we collect it
- When you call, email or WhatsApp us, or visit our Derby yard.
- When you submit an enquiry on our website (enquiries open in WhatsApp so you can review and send them yourself).
- When you sign up for stock alerts.
- Automatically, when you browse this website.
3. How we use your data
- To respond to your enquiries and arrange viewings, test drives and quotes.
- To process vehicle sales, part-exchanges, deposits, invoicing, delivery and export paperwork.
- To introduce you to finance or warranty providers when you ask us to.
- To provide after-sales support and handle warranty or other claims.
- To send you new stock alerts and offers, only where you have opted in.
- To meet our legal, tax (HMRC) and accounting obligations.
- To keep our website secure and understand how it is used so we can improve it.
4. Our lawful basis for processing
- Contract – to take steps at your request before a sale and to perform the contract of sale.
- Legal obligation – to keep financial records and comply with UK law, including anti-money-laundering checks where required.
- Legitimate interests – to run and improve our business, respond to business enquiries and keep our website secure, provided your rights do not override those interests.
- Consent – for marketing emails or messages and non-essential cookies. You can withdraw consent at any time.
5. Who we share your data with
We never sell your personal data. We only share it where necessary with:
- Finance, leasing and warranty providers, but only when you ask us to arrange these.
- Transport, delivery and export agents handling your vehicle.
- Our IT, website hosting, email and messaging service providers (for example WhatsApp).
- Our accountants, insurers and professional advisers.
- HMRC, the DVLA, law enforcement or regulators where the law requires it.
All third parties must keep your data secure and use it only for the purposes we have agreed.
6. International transfers
Some of our service providers (such as WhatsApp/Meta and Google) may process data outside the UK. Where this happens we rely on UK adequacy regulations or appropriate safeguards such as the UK International Data Transfer Agreement or Addendum. If you buy a vehicle for export, we will share the details needed with the relevant overseas parties so we can complete your order.
7. How long we keep your data
- Enquiries that do not lead to a sale – up to 24 months.
- Sales and financial records – 6 years from the end of the financial year, as required by UK tax law.
- Marketing data – until you unsubscribe or withdraw consent.
8. Cookies & analytics
We use essential cookies to make the website work. We also use analytics cookies (such as Google Analytics) to understand how visitors use the site. Non-essential cookies are only used in line with the Privacy and Electronic Communications Regulations (PECR). You can block or delete cookies in your browser settings at any time.
